Terms of Service

These Terms of Service govern use of americaretelehealth.us and the appointment-booking and telehealth services offered by Family Medicine and Research Center, PA d/b/a Americare Telehealth ("Americare Telehealth," "we," or "us"). You accept these Terms when you check the required acknowledgment box in our intake or when you book or use our services.

1. Medical services

Website content is general information and does not by itself create a clinician-patient relationship. A clinician-patient relationship is established only through a scheduled telehealth visit or another process recognized by Texas law. Americare Telehealth refill visits are scheduled appointments conducted by telephone (audio) or audio-video. We do not issue prescriptions or refills based on an online questionnaire alone.

3. Who provides care

Americare Telehealth is led by Nicholas Atudonyang, MD, a physician licensed by the Texas Medical Board. Your visit may be with Dr. Atudonyang or with a nurse practitioner (advanced practice registered nurse) licensed by the Texas Board of Nursing who works with Dr. Atudonyang under a prescriptive authority agreement as required by Texas law. We will tell you the name and credentials of your clinician before or at the start of your visit. In these Terms, "clinician" means the physician or nurse practitioner who provides your visit.

4. No emergencies

Americare Telehealth is not an emergency service. Do not use the website, scheduling system, text messaging, or email for an emergency. Call 911 or go to the nearest emergency department for emergency symptoms. For a mental health crisis, call or text 988.

5. No guarantee of diagnosis, treatment, or prescription

Booking or paying for a visit does not guarantee a diagnosis, prescription, refill, laboratory order, referral, work note, or any particular treatment. Clinical decisions remain within the professional judgment of your treating clinician.

6. Refill service limitations

The refill service is limited to selected established, non-controlled maintenance medications when clinically appropriate. Controlled substances and the excluded categories listed on our website are not provided through this service. Before making a prescribing decision, your clinician may require records, laboratory testing, current vital signs, pharmacy or prescription-history verification, a photo of your current prescription label, a video visit instead of a phone visit, or in-person evaluation.

7. Insurance and payment

Where we participate with your health plan (for example, eligible Blue Cross and Blue Shield of Texas PPO plans), we will bill your plan for covered services unless, before your visit, you choose in writing to pay out of pocket and ask us not to bill your plan. Insurance participation does not guarantee that a service will be covered or paid. You are responsible for copays, deductibles, coinsurance, non-covered services, and amounts your plan determines are your responsibility.

Cash-pay pricing applies when insurance is not used, not available, or you have elected self-pay, and is shown on our website and at booking before you pay.

8. Cancellations and refunds

Our Cancellation & Refund Policy applies to all visits and is shown before payment. In short: if you cancel before your visit begins, any visit fee you paid is refunded. Once your visit begins, the fee is for the clinician's evaluation and is generally not refunded, even if a refill is not medically appropriate.

9. Pharmacy and medication costs

Fees paid to Americare Telehealth do not include the cost of medication dispensed by a pharmacy. Pharmacy availability, pricing, substitutions, prior authorization requirements, and dispensing decisions are controlled by the pharmacy and your plan.

10. Your responsibilities

You agree to provide accurate information, keep your contact information current, attend scheduled visits, follow reasonable clinical instructions, and not misuse the service to obtain medication fraudulently or for another person.

11. Communications

If you give us a phone number or email address, you agree that we may contact you about scheduling, care coordination, billing, and service-related matters. Message and data rates may apply to text messages. You can stop text messages at any time by replying STOP or telling us. You may ask us to contact you by a different method for confidential communications. Do not send detailed health information by ordinary text or email.

12. Third-party services

We use third-party services for scheduling, video visits, payment, communications, hosting, and clinical operations. Current scheduling and video workflows may use Google Calendar and Google Meet, and payments may be processed by Stripe or another processor shown at booking. Their applicable terms may also apply. We do not guarantee uninterrupted availability of our website or third-party services.

13. Intellectual property

Americare Telehealth branding, original website text, graphics, and other proprietary materials may not be copied, republished, or used commercially without permission, except as allowed by law.

14. Educational content

Educational content on our website is not a substitute for individualized medical advice. Do not delay urgent or necessary medical care because of information on the website.

15. Limitation to the extent permitted by law

Nothing in these Terms limits rights or remedies that cannot lawfully be limited, including rights arising from professional medical duties. For non-medical website functions, liability is limited only to the extent permitted by applicable law.

17. Changes

We may update these Terms as our services change. The version posted on the website at the time of use applies, subject to applicable law.

18. Governing law

These Terms are governed by applicable federal law and the laws of the State of Texas, without altering any mandatory patient rights or professional obligations.
